In this article we consider certain elements of the normative theory of Jürgen Habermas in the light of the proposals of Bruce Ackerman, with a view to strengthening a concept of deliberative democracy applied to the legitimation of juridical rules. We do not construct a hierarchy of the two positions, but seek to bring together certain elements to achieve a common project. As the starting point for examining the work of the two authors, we take the scheme proposed by Habermas (...) in Faktizität und Geltung. In this connection, through the work of Ackerman, we intend to fill in some of the gaps that Habermas appears to have left in the theory of radical democracy applied to the law. The work of Ackerman can make a significant contribution to deliberative democracy, to the discourse principle that Habermas defines, and to the contractualist theories from a liberal perspective. The study of these contributions makes possible a critical judgment that enables the legitimation of juridical rules carried out by Habermas to acquire greater practicity. In examining the epistemological status of juridical science and law, we attempt to determine the weight and the performance of normative democracy. In Tarr's view, it is a matter for philosophers to examine direct democracy and its desirability. (shrink)

The present article commences analyzing the origins and influences of the religious discourse on the configuration of the modern constitutional discourse and the contributions of the jus-positivism in the consolidation of this sacred-civil language. The second issue is the definition of the U.S. Constitution as a mixed and not as a democratic constitution, with regard to the influences of Plato, Aristotle, Cicero and Polybius to the Drafters of the first modern constitutional text; stability and equilibrium took preference over democracy in (...) a wide sense. Llegados al final del periplo para definir al rey y al político, el Forastero y el joven Sócrates se encuentran en un callejón sin salida; no han podido determinar el perfil de cada uno de ellos. La narración del mito será la enmienda del método utilizado hasta ahora, i.e. la diéresis o división, que los ha llevado a una situación aporética. El Forastero muestra que se han cometido dos errores a lo largo del recorrido: el primero ha sido confundir lo (...) humano con lo divino; el segundo, de más envergadura, no establecer claramente la manera cómo el rey y el político podían ser el gobernante de la ciudad entera. Éste es uno de los pasajes más relevantes del Político de Platón, pues en él se realiza una reflexión sobre la naturaleza del error cometido. (shrink)

The example of the bees, as they appear in Plato’s Phaedo, taken up again in Aristotle’s Politics and in Hobbes’ commentary contained in Leviathan, shows the potential of the phenomenological reading of examples as a method of understanding the basis on which philosophical thought is determined. Sign and communication are peculiar to gregarious and political animal life. In seeking to embody the Aristotelian concept of lógos in the context of a living community, as the basis for interaction and co-existence, we (...) must be sure that our interpretation does not reduce it to what, according to Aristotle, is simply animal behaviour. The Platonic sequence “ass, wolf, bee, god” situates the model of political life between a life in injustice and a life in wisdom. The Aristotelian variationdetermines the lógos on what is just and what is unjust as a natural increment in lucidity, compared with the mere exercising of gregariousness and sociability. Hobbes’ inversion of the Aristotelian example considers a natural reality in the light of the distortions that complicate and make it impossible. Hobbes thus shifts human politics towards artificiality that renders it viable. In each case, the example holds up a different mirror to the same reality. (shrink)

Hobbes redefines his conception of liberty in the Leviathan as the absence of external impediments to motion. Power, on the other hand, refers to the body’s intrinsic dimension, that is, to the faculties possessed by each individual. There thus appears to be a clear distinction between liberty and power in Hobbes’ political philosophy. Taking into consideration Hobbes’ Latin works, however, in which he uses two different terms to refer to power: at times potestas and others potentia, such a distinction may (...) need to be revisited. As we will argue, there is a marked relation between liberty and power when considering human sociability. In this way, the aim of the article is to discuss Hobbes’ conception of power, through the pages of the Leviathan and De Homine, trying to clarify its complex, even ambiguous relation with his conception of liberty. This essay examines the relationship between Eric Voegelin and Leo Strauss in order to show the central themes necessary to elucidate their philosophical positions. The essay reveals the centrality of the figure of Plato as a point of departure to understand the agreement and the disagreement concerning fundamental questions (such as the way of reading ancient texts, the importance of the historical perspective or the importance of the study of the past in order to orient the modern science) which revolves (...) around the issue of the relation between revelation and philosophy. The work concludes with an identification of the common core of both thinkers that allows us to understand their differences (homogeneity or heterogeneity of reality and the human) and, moreover, identifies both perspectives with a «foundational» (Voegelin) or «negative» (Strauss) interpretation of Plato’s thought. The first segment starts with a definition of two dimensions of the concept of rule of law; related to the notion of sovereignty and as a concept to control arbitrariness on the part of the ruler. The segment proceeds to give a historical account of the notion and the different stages of its epistemological configuration, from the ancient Greek notion of Eunomia and its incompatibility with the popular rule to the current notion, where the rule of law has become fused (...) with democracy and human rights. The first segment also focuses on the relation between the concept of the rule of law and other principles, such as proportionality, neutrality, and effectiveness. The second segment of the paper analyses the phenomenon of juridification of the rule of law in international treaties and domestic constitutions. It pays particular attention to the role that constitutional accommodation plays in the process of rationalization of the rule of law as a prerequisite to its idealization and mystification. It analyses the reason why this principle is an essential feature of the constitutionalism despite the inner plurality of legal systems. The next aspect, analysed in the third segment of this paper, is the messianic use of the concept of the rule of law. The paper performs a critical definition of messianic, covering a theological perspective and the different theories and concepts that go hand in hand with the idea of the Messiah, such as the “coming”, prophetical and apocalyptical messianism, the phenomena of eschatology, expiation and redemption pictured in Judaism. The segment also covers the secular transplantation of the messianic thought. The last segment is a conclusion returning to the themes identified in the paper and summarises how the messianic thought is applied in the realm of the rule of law. (shrink)

Este artículo se ocupa del problema de cuál pueda ser la naturaleza de la creencia y cuál la mejor explicación de su normatividad. Se analizan diversas teorías que desarrollan el modelo ¿estado más contenido¿, y se presenta como alternativa una concepción de filiación wittgensteiniana que entiende la creencia como acción simbólica y expresiva.

El control efectivo de la calidad y seguridad de los ali­mentos requiere de métodos analíticos que garanticen la deter­minación fiable de cualquier sustancia potencialmente perjudicial para el consumidor que pueda estar presente en el alimento antes de su distribución y comercialización. Una de las aproximaciones analíticas que contribuye a garantizar este objetivo engloba una serie de técnicas que tienen en común la utilización de anticuerpos como elementos esenciales para la detección del analito diana, y que en conjunto reciben el nombre (...) de métodos inmunoquímicos. Este artículo pretender aportar una visión básica de los principios bioquímicos subyacentes a estas tecnologías y cuáles son sus venta­jas y limitaciones en la determinación de contaminantes químicos, residuos y aditivos en matrices alimentarias. En la última parte se comentan algunas de nuestras iniciativas en este ámbito que han dado lugar a kits rápidos disponibles comercialmente tras haber transferido la tecnología correspondiente al sector industrial. Łukasiewicz’s infinite-valued logic is commonly defined as the set of formulas that take the value 1 under all evaluations in the Łukasiewicz algebra on the unit real interval. In the literature a deductive system axiomatized in a Hilbert style was associated to it, and was later shown to be semantically defined from Łukasiewicz algebra by using a “truth-preserving” scheme. This deductive system is algebraizable, non-selfextensional and does not satisfy the deduction theorem. In addition, there exists no Gentzen calculus fully adequate (...) for it. Another presentation of the same deductive system can be obtained from a substructural Gentzen calculus. In this paper we use the framework of abstract algebraic logic to study a different deductive system which uses the aforementioned algebra under a scheme of “preservation of degrees of truth”. We characterize the resulting deductive system in a natural way by using the lattice filters of Wajsberg algebras, and also by using a structural Gentzen calculus, which is shown to be fully adequate for it. This logic is an interesting example for the general theory: it is selfextensional, non-protoalgebraic, and satisfies a “graded” deduction theorem. Moreover, the Gentzen system is algebraizable. The first deductive system mentioned turns out to be the extension of the second by the rule of Modus Ponens. (shrink)

Guizot aprendió el oficio de historiador preparando con su esposa,Pauline de Meulan, una edición crítica en francés de _Decline and Fall_ de Gibbon. Las personalidades históricas de Gibbon y Guizot fueron muy distintas. También sus respectivos “estilos de historia”. Pero en las obras de Guizot, en especial en su _Historia de la civilización en Europa_, es reconocible el legado de Gibbon. Así, en la eliminación de la barrera entre historia civil y historia religiosa, en la amplitud temática, en la ambición (...) cronológica y en una idea de Europa concebida como algo más que la suma de sus partes. Asimismo en la adopción de la misma palabra _civilización_ y en el hecho de que la interpretación guizotiana de la historia europea hunda sus raíces en tres factores presentes en Gibbon: lo que sobrevivió de las instituciones romanas, el impacto del cristianismo y el aporte germánico.
